NOTICE TO DEFENDANT: “You have been sued. You may employ an attorney. If you or your attorney do not file a written answer with the clerk who issued to this citation by 10:00 a.m. on the Monday next after the expiration of forty-two days after the date of issuance of this citation and petition, a default judgment may be taken against you.”
TO: DEFENDANT(S), GREETING: CECILIO MARTINEZ AND THE UNKNOWN HEIRS, IF ANY, OF CECILIO MARTINEZ, AND
ALL PERSONS CLAIMING ANY TITLE OR INTEREST IN LAND UNDER DEED FROM LEOPOLDO PALACIOS AND REFUGIA PALACIOS TO CECILIO MARTINEZ, ET AL, AS GRANTEE
YOU ARE HEREBY COMMANDED to appear by filing a written answer to the Plaintiff’s Original Petition for Declaratory Judgment at or before ten o’clock a.m. of the Monday next after the expiration of forty-two days after the date of issuance of this citation the same being the 7th day of March, 2011 A.D. before the Honorable 370th District court of Hidalgo County, Texas at the Courthouse of said County, Edinburg, Texas. Said Plaintiff’s Original Petition for Declaratory Judgment was filed in said court on the 1st day of October, 2010 A.D. in this case, numbered C-3077-10-G on the docket of said court, and styled, Alicia Muniz, Plaintiff VS Cecilio Martinez, Defendant.
Said petition was filed in said court by: Attorney DARRELL DAVIS, 301 E. TOM LANDRY STREET, MISSION, TEXAS 78572, (956) 585-1622.
A brief nature of the suit is as follows:
Plaintiff Amelia Muniz asks the court to enter a final judgment declaring that Juana Palacios Martinez, Alicia Palacios Muniz, Isidro Palacios were and are the heirs of Leopoldo Palacios and Refugia Palacios, and that said heirs or their assigns are the owners of Lot 9, Block 2, Colonia Guadalupe, an addition to the City of McAllen, Hidalgo County, Texas free and clear of any interest of Cecilio Martinez, and his unknown heirs.
The office executing this writ shall promptly serve the same according to requirements of law, and the mandates thereof, and make due return as the law directs.
ISSUED AND GIVEN under my hand and the seal of said Court at Edinburg, Texas, this 18th day of January, 2011.
