ORDINANCE NO. 3668
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MISSION ABANDONING PORTIONS OF PINO AND GRANJENO STREETS AND ALLEYS BETWEEN AND IN BLOCKS 7, 10, AND 11, ALTA VISTA SUBDIVISION, MISSION, HIDALGO COUNTY, TEXAS.
WHEREAS, the plat of Alta Vista Subdivision, recorded in Volume 5, Page 23, Map Records of Hidalgo County, Texas depicts publicly dedicated streets and alleys between and in Blocks 7, 10, and 11; and,
WHEREAS, the portion of Pino Street between Blocks 10 and 11, and the portion of Granjeno Street between Block 7 and 10, are un-improved streets; further, the 10’ alleys within Blocks 7, 10, and 11, Alta Vista Subdivision also have never been used as public alleys; and,
WHEREAS, the City of Mission, Texas has been presented with a development plan to build a new church with associated off-street parking that would necessitate the abandonment of these publicly dedicated right-of-ways, and said church has requested of the City to consider such abandonment of these publicly dedicated right-of-ways, and said church has requested of the City to consider such abandonment; and,
WHEREAS, the city has determined that there are no public utilities within these rights-of-ways, and that abandonment of said right-of-ways would not be contrary to the City’s best interests.
NOW, THEREFORE, AFTER CONSIDERING SUCH REQUEST FOR ABANDONMENT IN A PUBLIC HEARING, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MISSION, TEXAS THAT:
Section 1: The City of Mission does by these presents abandon to the use of the general public Pino Street between Block 10 and Block 11; and Granjeno Street between Block 7 and Block 10; and also abandons the 10-foot alleys within Blocks 7, 10, and 11, Alta Vista Subdivision, as shown on “Exhibit A’.
Section 2: This ordinance shall be recorded at the County Clerks’ Office of Hidalgo County, Texas.
READ, CONSIDERED, APPROVED AND passed on this the 22nd day of AUGUST, in the Year of Our Lord, 2011.
