Hidalgo-County-SealDistrict Judge Robert Blackmon granted a summary judgment filed by State Rep. Sergio Muñoz Jr. on an election contest for the March primaries Monday morning.

Rolando Rios, attorney for Mari Regalado, who filed the contest, had asked for a continuance, arguing that the information his client needs for the case will come to the light in the next few weeks. A grand jury, he said, has requested a forensic analysis of the voting machines used during the primaries. Hidalgo County Commissioners Court placed an item on Tuesday’s agenda to approve $110,000 of the district attorney’s forfeiture funds for the endeavor.

They should have results, he said, within one to two weeks.

Blackmon’s questioning focused on filed complaints, and he pointed out an affidavit from a voter filed with the court is the only complaint he’s seen.

“So far we have no evidence of fraud in relation to the voting machines or on the part of any election officials,” Blackmon said.

He also asked Rios why he had not asked the court to help Regalado get access to the machines to bring in an expert to analyze the equipment.

Rios said he did not believe the court had jurisdiction over the machines because another judge had impounded them.

“If some evidence turns up, and I still have jurisdiction on this matter, I will reconsider,” Blackmon said.
